1 – Purpose of the general conditions of sale (CGV)

1.1. – The purpose of these general conditions of sale is to define the contractual provisions between:

  • The Musérial du Fort des Dunes (located Chemin du Fort, 59495 Leffrinckoucke), represented by the Town Hall of Leffrinckoucke (located 330 rue Roger Salengro, 59495 Leffrinckoucke – SIRET 215.903.402.000.18);

And

  • Any natural or legal person (hereinafter referred to as the “Buyer”) purchasing tickets or individual tickets on this online sales site https://fort-des-dunes.fr/.

These general conditions of sale therefore do not apply to ticket sales made on site at the Musérial du Fort des Dunes (located Chemin du Fort, 59495 Leffrinckoucke).

The Buyer acknowledges having read these general conditions of sale prior to validating his order: placing an order implies the Buyer’s full and irrevocable acceptance of these general conditions of sale.

The Musérial du Fort des Dunes, represented by the Town Hall of Leffrinckoucke, reserves the right to adapt or modify these general conditions of sale at any time and without notice. The applicable conditions are those in force on the day the order is placed.

1.2. – Definitions

All terms listed below, whether used in the singular or plural, are used with the following meaning:

– “General Conditions of Sale (CGV)”: designate these general conditions which aim to define the conditions of purchase and use of Tickets.

– “Ticket”: generally refers to the entry ticket allowing access to the Musérial du Fort des Dunes, whatever its medium, purchased by the Customer on the Site. Ticket prices are available on this site and are identical to the price on site. The applicable price is that in effect on the day of the order.

– “Ticket”: generally refers to the reservation ticket allowing access to one of the events published on this Musérial du Fort des Dunes website. Certain events, for example shows at the ZUM Théâtre, are in fact only accessible by having made a reservation in advance.

– “Buyer”: designates any person purchasing a Ticket or Ticket on this site and having accepted the General Conditions of Sale.

– “Visitor”: designates the person presenting themselves at the entrance to the Musérial du Fort des Dunes with a Ticket or Ticket.

2 – Characteristics of tickets sold

2.1 – The tickets offered on this site are intended for one or more of the following services:

  • Entrance to visit the Musérial du Fort des Dunes, allowing access to the permanent exhibitions and temporary exhibitions of the Musérial, as well as access to the exterior spaces of the Musérial;
  • Use of the Musérial du Fort des Dunes audio guide;
  • Visits and activities for young people and families at the Musérial du Fort des Dunes;
  • Combined ticket: Musérial du Fort des Dunes – Musée Dunkerque Dynamo 1940.
  • Events, shows, concerts and conferences at the Musérial du Fort des Dunes, within the ZUM Théâtre or in the different spaces of the Fort des Dunes.

2.2 – The number of Tickets sold online per order and per person is limited in quantity as follows:

  • 10 maximum for entry to the Musérial du Fort des Dunes;
  • 10 maximum for twin tickets;
  • 4 maximum for the special “Parcours Jeunesse” ticket;
  • 10 maximum for events, shows, concerts and conferences.

The same person cannot place several orders spaced over time to circumvent this rule. Reservations for groups of more than 10 people must be made following the instructions on the dedicated group reservation request form.

Purchases of Tickets and Tickets are made in real time. In this context, the site informs the buyer of the availability of the desired tickets at the time of placing their order.

2.3. – The following information is given on the Tickets issued by the Musérial du Fort des Dunes:

  • Name and/or logo of the Musérial du Fort des Dunes;
  • Name of the service sold;
  • Date of service (and times if applicable);
  • Type of rate and amount in euros including tax (all taxes included);
  • The date of purchase of the ticket;
  • The reservation number allowing validation of the ticket/ticket at the entrance to the museum.

3 – Order process on the online ticket office

The Buyer makes his or her Ticket purchase online as follows:

3.1 – Ticket office to visit the Musérial:

  1. Access the ticketing page, then “free visit ticket”;
  2. Choose the date of visit, the types and number of tickets desired, then validate;
  3. Check the basket then validate to access the order validation page
  4. Provide your contact details. It is not obligatory to create an account to purchase tickets on this site;
  5. (optional) It is possible to check the “create an account” box to have an account on the site allowing you to save the various purchases made on the site;
  6. Accept the General Conditions of Sale and click on “order” in order to be redirected to the PayFip payment gateway;
  7. The payment and order finalization process is described in point 3.3.

3.2 – Ticketing for calendar and ZUM Theater events:

  1. Access the “Agenda” or “Zum Théâtre Programming” page;
  2. Select the event that interests you;
  3. Choose the number of tickets desired, then validate;
  4. Check the basket then validate to access the order validation page
  5. Provide your contact details. It is not obligatory to create an account to purchase tickets on this site;
  6. (optional) It is possible to check the “create an account” box to have an account on the site allowing you to save the various purchases made on the site;
  7. Accept the General Conditions of Sale and click on “order” in order to be redirected to the PayFip payment gateway;
  8. The payment and order finalization process is described in point 3.3.

3.3 – Payment process (identical for all online ticketing):

  1. After clicking “order”, you are redirected to the PayFip payment gateway;
  2. Make the payment by credit card on the “PayFip” payment page according to the 3D Secure standard by following the instructions on the screen and transmitted by your bank;
  3. If the payment is accepted, a payment confirmation is displayed and it is possible to download an invoice in pdf format;
  4. Click on “continue” to finalize the order and return to the Musérial du Fort des Dunes website.
  5. The order confirmation page is then displayed and the Buyer receives a summary email with their Ticket(s);
  6. The Buyer prints their Ticket(s) or downloads them to their mobile phone.

As long as the payment has not been recorded, the Buyer has the possibility to modify or cancel the content of his order by going to the basket page.

Once payment has been confirmed, no cancellation or modification is possible by the Buyer.

If the payment failed: the Buyer then receives no payment confirmation or ticket. You must then try to make the purchase again from the cart page.

If you have received the Payfip payment invoice but not the tickets: please contact us to verify your reservation and return the tickets to you.

4 – Ticket Prices / Tickets

Ticket prices are indicated in euros, all taxes included (TTC). The applicable prices are those in effect at the time of the order. The Musérial du Fort des Dunes reserves the right to modify prices at any time.

The Visitor likely to benefit from a reduced rate or free admission must present valid proof of access to the services, in their name and with a photograph, at the entrance to the services. In the event of non-presentation or non-compliance of supporting documentation, access to the service will be refused.

By purchasing a Full Price Ticket/Ticket, the Buyer waives the right to benefit from any reduction or freebie to which he could possibly have been entitled for his visit.

5 – Online payment terms

All orders, whatever their origin, are payable in Euros.

Payment for Tickets is made by credit card. The cards accepted for payment of an order at the ticket office are cards from the Carte Bleue / Visa and Eurocard / Mastercard / American Express networks. The Buyer’s bank account is debited upon final validation of the order.

The Musérial du Fort des Dunes uses the secure online payment of the French State entitled “Payfip” and certified by international authorities.

The payment process is integrated into the sales and reservations solution of this site by redirecting the Buyer to the official Payfip website when making the purchase. Consequently, no banking data passes through this website.

6 – Conditions of use of tickets

6.1 – The email containing the Ticket / Ticket information can be printed upon receipt of the order confirmation email. It must be presented at the Musérial reception. Tickets / Tickets downloaded on mobile phones are also accepted as proof.

Each service purchased corresponds to a Ticket. Partially or poorly printed, damaged or illegible Tickets are not valid.

It is strictly prohibited to duplicate or counterfeit a Ticket in any way.

6.2 – Tickets / Tickets are time-stamped and valid exclusively for the service, on the date mentioned (and at the time indicated, if applicable).

Visit tickets allow access to the Musérial du Fort des Dunes on the day indicated on the ticket. A Ticket only gives access to the corresponding service once and any exit is final. If you need to postpone your date of visit to the Musérial, please contact us to postpone your visit date: the ticket remains valid for 3 months.

6.3 – Each Ticket purchased online is personal and non-transferable. The first person to present the note is presumed to be the legitimate bearer. Access to the service will be refused to any other person who presents themselves subsequently with a copy of the ticket.

6.4 – Access to the service is subject to checking the validity of the Ticket. The Visitor must keep their Ticket for the entire duration of the service.

The Musérial du Fort des Dunes declines all responsibility in the event of loss or theft or use of copies, including within the Musérial.

7 – Personal data (GDPR)

7.1 – Data collected

The Buyer is hereby informed that his personal data collected via this site are used by the Musérial du Fort des Dunes (represented by the Town Hall of Leffrinckoucke) which acts as data controller within the meaning of the Regulation (EU ) 2016/679 of April 27, 2016 (hereinafter “General Data Protection Regulations”).

When placing the order, the following personal data is requested from the Buyer: name, first name, email address, telephone number, billing city, postal code.

Only data identified with an asterisk are mandatory and necessary for processing. Without the mandatory data, the Buyer’s request cannot be taken into account.

7.2 – Use of collected data

The Buyer’s personal data is collected for the following purposes:

  • management of Orders and relations with the Buyer;
  • sending newsletters from Musérial du Fort des Dunes by email (subject to prior acceptance by the Buyer when ordering). The Buyer can unsubscribe at any time by clicking on the unsubscribe link in each email.

In this context, the legal basis of the processing is either contractual when it comes to managing purchases or, based on consent with regard to the Buyer’s registration for the Musérial du Fort des newsletter. Dunes.

The Buyer may, if necessary, lodge a complaint with the CNIL, the supervisory authority responsible for compliance with obligations regarding the protection of personal data.

8 – Cancellation, refund and exchanges

8.1 In accordance with article L 121-21-8-12° of the Consumer Code, Entrance Tickets or services for a museum are not subject to a right of withdrawal.

8.2 Tickets and Tickets are non-transferable, non-modifiable, non-exchangeable and cannot be resold.

8.3 Any Ticket issued cannot be exchanged or refunded, except in the event of cancellation or modification by the Musérial du Fort des Dunes of the service to which the Ticket entitles you and under the conditions defined in article 8.4 . Exchange or reimbursement is however excluded when the cancellation results from a case of force majeure as defined in article 10.

8.4 Due to requirements for the safety of people and property, the Musérial du Fort des Dunes reserves the right to close or modify its opening hours or to cancel or postpone a service.

In the event of cancellation or modification of the service appearing on the Ticket / Ticket by the Musérial du Fort des Dunes:

  • the Buyer will be contacted as soon as possible to inform them and if possible propose the postponement of the service concerned.
  • If postponement is impossible, the Buyer may obtain a refund of the price of the Ticket/Ticket.

To obtain this refund, the Buyer must make a request within three (3) months from the date of cancellation or modification of the service, upon presentation of the non-invalidated Ticket and their RIB bank details ( Bank details) :

This reimbursement will only be made in favor of the initial Purchaser against delivery of the Ticket.

No other compensation or compensation whatsoever may be requested other than reimbursement of the ticket(s).

9 – Responsibility

9.1 The Musérial du Fort des Dunes (represented by the Town Hall of Leffrinckoucke) cannot under any circumstances be held liable for any non-performance or poor performance of the services to which the Tickets entitle you which could be attributable either to the act of the Buyer or to the unforeseeable and insurmountable act of a third party, or a case of force majeure as defined in article 11 of these General Conditions of Sale.

9.2 Unless there is a malfunction of the Site which is attributable to it, Le Musérial du Fort des Dunes cannot be held responsible for any anomalies that may occur during the ordering, processing, downloading or printing of the Ticket, either due to the Buyer, either due to the unpredictable and insurmountable fact of a third party not involved in the service, or due to computer or server failures, the blocking of telecommunications including networks and in particular the Internet.

9.3 The Musérial du Fort des Dunes (represented by the Town Hall of Leffrinckoucke cannot be held responsible for the use of the Tickets purchased, the Buyer being solely responsible for their use by himself or by a third party.

10 – Force majeure

The Buyer and Le Musérial du Fort des Dunes (represented by the Leffrinckoucke Town Hall) cannot be held responsible for any non-performance caused by a case of force majeure considered as such by French case law and courts.

For any information or questions concerning the use of the Site, the conditions of use of Tickets / Tickets as well as the terms of ordering, delivery and reimbursement of Tickets, the Buyer can contact customer service:

12 – Possible recourses

All Visitors are subject to the visiting regulations of the Musérial du Fort des Dunes.

Ticket sales referred to in these General Terms and Conditions are subject to French law. In the event of a dispute or complaint, the Buyer will first contact the Musérial du Fort des Dunes (represented by the Leffrinckoucke Town Hall) to obtain an amicable solution. Disputes fall under the jurisdiction of Dunkirk.
